Terms of Service - 1SecondPainting

Note: 1SecondPainting has been discontinued. The service no longer accepts new orders, processes payments, or generates new paintings. These terms are preserved for reference and apply to historical use of the platform.

1. Acceptance of Terms

By accessing or using the 1SecondPainting website and services, you agreed to be bound by these Terms of Service. If you did not agree to these terms, you were not permitted to use the service.

2. Service Description

1SecondPainting was an AI-powered art generation service that produced unique, algorithmically generated paintings on demand. The service has been permanently discontinued. No new orders can be placed, and the generation service is no longer available.

3. Orders and Payments

All sales were final at the time of purchase. Payments were processed securely via Stripe. Pricing was displayed in USD. Orders placed during the active period of the service were fulfilled according to the terms in effect at the time of purchase.

4. Intellectual Property

Each painting generated by 1SecondPainting was unique and produced exclusively for the purchasing customer. Upon delivery, the customer received a non-exclusive, personal license to display and reproduce the painting for personal, non-commercial use. 1SecondPainting retained rights to the underlying algorithms, models, and software.

5. Refunds and Returns

As the service is discontinued, no new refund requests can be processed. Customers with outstanding issues from orders placed while the service was active may contact us and we will do our best to assist on a case-by-case basis.

6. Prohibited Uses

While the service was active, users were prohibited from:

Reselling or redistributing generated paintings without express written permission.
Using the service to generate content that was illegal, harmful, or infringing on third-party rights.
Attempting to reverse-engineer or scrape the generation service.
Misrepresenting AI-generated works as hand-made or human-created art for commercial gain.

7. Disclaimers

The service was provided "as is" without warranties of any kind, express or implied. 1SecondPainting did not guarantee that the service would be uninterrupted, error-free, or that outputs would meet any particular aesthetic standard.

8. Limitation of Liability

To the maximum extent permitted by law, 1SecondPainting shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the service or inability to use the service.

9. Governing Law

These terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law provisions.
